ORDER
After due and proper consideration of all issues raised, and a de novo
determination of those portions of the Report and Recommendation to which objection
is made, the Recommendation of the Magistrate Judge made under 28 U.S.C. ยง
636(b)(l)(B), and dated October 27, 2017 (doc. 20), is ADOPTED as the opinion of this
Court.
It is further ORDERED that Petitioner is not entitled to a certificate of
appealability and he is not entitled to proceed in forma pauperis on appeal.
