ORDER
After due and proper consideration of the issues raised, and there having been no
objections filed, the Report and Recommendations (Doc. 24) of the Magistrate Judge made under
28 U.S.C. § 636(b)(1)(B)-(C), Federal Rule of Civil Procedure 72(b), and S.D. Ala. GenLR
72(a)(2)(S), and dated December 1, 2017, is ADOPTED as the opinion of this Court.
Accordingly, it is ORDERED that the Defendants’ Motion to Dismiss for Failure to
Prosecute (Doc. 19) is GRANTED, that Plaintiff Alfred Blackman’s claims against the
Defendants in this action are DISMISSED with prejudice under Federal Rule of Civil
Procedure 41(b), and that the Defendants’ counterclaims against Blackman are DISMISSED
without prejudice under Federal Rule of Civil Procedure 41(a)(2).
Final judgment shall issue separately in accordance with this order and Federal Rule of
Civil Procedure 58.
