ORDER
After due and proper consideration of the issues raised and a de novo determination of
those portions of the recommendation to which objection is made, the Report and
Recommendation of the Magistrate Judge (Doc. 9) made under 28 U.S.C. § 636(b)(1)(B)–(C),
Fed.R.Civ.P. 72(b), and S.D. Ala. GenLR 72(a)(2)(S), and dated December 1, 2020, is ADOPTED
as the opinion of this Court.
Accordingly, it is ORDERED that pursuant to Rule 41(b) Fed.R.Civ.P., Plaintiff KingLew
Investments, Inc.’s claims against the Defendants are DISMISSED without prejudice. The Clerk
of Court is DIRECTED to terminate KingLew Investments, Inc. as an active party to this action.
Plaintiff Lewis Giles Jr.'s claims against the Defendants remain in this case.
