ORDER - that Petitioner's claims of ineffective assistance of counsel are denied with prejudice. IT IS FURTHER ORDERED granting a certificate of appealability on Petitioner's claim that counsel performed ineffectively at sentencing by faili ng to investigate and present mitigating evidence of Petitioner's traumatic brain injuries and their effect on his mental processes. For the reasons set forth herein, the Court declines to grant a certificate of appealability on Petitioner' s other claims. IT IS FURTHER ORDERED that the Clerk of Court shall enter judgment in accordance with this Order and send copies of the Order to all counsel of record, to Petitioner, and to the Capital Case Staff Attorney. IT IS FURTHER ORDERED that the Clerk of Court forward a copy of this Order to Rachelle M. Resnick, Clerk of the Arizona Supreme Court, 1501 W. Washington, Phoenix, AZ 85007-3329.
