ORDER that Petitioner's Amended Petition 42 for Writ of Habeas Corpus, is DENIED. The Clerk of Court shall enter judgment accordingly. FURTHER ORDERED that the stay of execution entered by this Court on April 28, 2003, Dkt. 2, is VACATED. FURT HER ORDERED GRANTING a Certificate of Appealability as to thefollowing issues: Whether Claim 1 of the Amended Petition alleging that Petitioner's rights were violated by the use of dual juries is without merit. Whether Claim 4 of the Amended Pet ition alleging that Petitioner's rights were violated by the use of a leg brace at his trial is without merit. FURTHER ORDERED that the Clerk of Court forward a courtesy copy of this Order to the Clerk of the Arizona Supreme Court, 1501 W. Washington, Phoenix, AZ 85007-3329.
