DeConcini, Peter Sperling, and Laura Palmer Noone (Doc. 120) is GRANTED; (2) the Alternative[] [Motion] to Strike Portions of Lead Plaintiffs Second Amended Complaint for Violations of the Federal Securities Laws[] (Doc. 120) by the defendants listed in paragraph (1) above is DENIED as MOOT; (3) the Motion to Dismiss by Defendant Apollo Group, Inc. (Doc. 122) is GRANTED; and (4) the Motio n for Judicial Notice in Support of Lead Plaintiff's Omnibus Opposition to Defendants' Motion to Dismiss the Second Amended Complaint for Violations of the Federal Securities Laws by Plaintiff Pension Trust Fund for Operating Engineers (Doc . 131) is GRANTED. IT IS FURTHER ORDERED that the Second Amended Complaint (Doc. 112) is DISMISSED WITH PREJUDICE. The Clerk of the Court is directed to enter JUDGMENT in favor of defendants and terminate thecase.
