Section 3161 (h)(1) will occur as a result of this motion or from an order based thereon. The Defendant above, through counsel undersigned, respectfully motions this Court to continue for 6 weeks his 10/31/07 sentencing, for the following reasons: 1. Attorney undersigned has been notified by Federal Probation Officer Michelle Castillo that the District of California has reconsidered a previous request to transfer jurisdiction on Defendant's pending probation revocation and has agreed to transfer jurisdiction to this District. 2. The probation department will need an additional six weeks to process the revocation from initial appearance to disposition: it is anticipated that Defendant will accept responsibility and has no objection to the continuance. 3. Defense attorney has spoken with and AUSA Aaron Wegner who has no objection to the continuance. For the reasons stated it is respectfully motioned that this Court continue for six weeks the forementioned sentencing. It is anticipated that a disposition will be scheduled at the same time.
