The Court held a status hearing on April 16, 2007 (Doc. #164), regarding Plaintiff Miguel Gonzales's motion for entry of default judgment against Defendant Bill Mitchell. After reviewing Plaintiff's oral motion for default judgment and the affidavit in support submitted on September 6, 2005 (Doc. #91), the Court ordered Plaintiff to appear at 3:30 p.m. on May 29, 2007 (Doc. #165) to offer evidence on the amount, if any, of default damages against Defendant Mitchell. Plaintiff failed to appear for the hearing. The Court therefore finds that Plaintiff is entitled to a default judgment of $0.00 against Defendant Bill Mitchell. This decision resolves all remaining issues in this case. Accordingly, It IS ORDERED that the Clerk of the Clerk shall enter the following final judgment in this case:
