CV31-0061-TUC-SRB Freeport McMoran Applications SCHEDULING ORDER The Court has considered the Joint Motion to Modify the Discovery Schedule for the Freeport McMoRan Corporation's Applications for Sever and Transfer of Gila River Water Rights and for good cause showing, grants that motion. This Court's June 10, 2009 Scheduling Order and subsequent August 5, 2009 Scheduling Order is modified only as set forth below. A. Answers to Interrogatories, Requests for Production, and Requests for Admission shall be served no later than November 9, 2009. B. The parties shall disclose the identity of all persons who may be used at trial to present evidence under Fed.R.Evid. 701, 702, 703, 703, 704, and 705 no later than November 9, 2009. No deposition of any expert witness shall occur before the disclosures concerning expert witnesses mandated by this Order are made. The disclosures of the identities of all persons who may be used at trial to present evidence under Fed.R.Evid. 701, 702, 703, 703, 704, or 705 shall also include all of the disclosures required by Fed.R.Civ.P. 26(a)(2)(B) if the witness is either (1) retained or specifically employed to provide expert testimony in the case, or (2) an agent or Dockets.Justia.com employee of the party offering the testimony whose duties regularly involve giving expert testimony. C. Rebuttal experts, if any, shall be disclosed by December 7, 2009. D. The parties are required to finally supplement all discovery, including material changes in expert witness opinions and disclosure, pursuant to Fed.R.Civ.P. 26(a)(3), of all exhibits to be used and all witnesses to be called at trial, on or before December 31, 2009. E. All discovery must be completed by December 31, 2009. All other deadlines and requirements of the June 10, 2009 Scheduling Order and August 5, 2009 Scheduling Order remain in effect and unchanged.
