JOINT REPORT RE: SETTLEMENT AND REQUEST FOR EXTENSION OF DEADLINE FOR PRE-TRIAL ORDER

Pursuant to the Court's September 8, 2006 order (Doc. #15), the parties hereby file their joint report regarding settlement discussions. The parties' counsel have discussed settlement without success, but have agreed to attend a private mediation on August 24, 2007. The parties' counsel were unable to attend a mediation prior to mid-August due to litigation deadlines and other scheduling commitments. The August 24 date was the earliest date that the parties could arrange for a mediator based upon the schedule of the parties' counsel and the mediator. The Court's deadline for filing a joint pre-trial order is August 17, 2007. [Doc. #46 ] Based upon the available date for mediation, the parties' request that the deadline for filing the joint pretrial order be extended for approximately thirty (30) days until September 17, 2007.
