ORDER - for the reasons set out within this order, defendants' motion at docket 69 is GRANTED IN PART and DENIED IN PART as follows: Defendants' motion is granted as to plaintiff's claims for breach of contract, rescission of contract, breach of the covenant of good faith and fair dealing, and breach of warranty, and denied as to plaintiff's claims of fraud and negligent misrepresentation and request for consequential damages based on those theories.
