Pursuant to the parties motion for Preliminary Injunction and good cause
appearing therefor,
IT IS HEREBY ORDERED that pursuant to Title II of the Americans with
Disabilities Act of 1990, 42 U.S.C. § 12132, and Section 504 of the Rehabilitation Act of
1973, 29 U.S.C. § 794, Arizona State University and the Arizona Board of Regents are
enjoined from implementing their program to provide inaccessible Kindle DX electronic
books to ASU students for the Fall semester, starting August 24, 2009.
