ORDER - IT IS ORDERED that the first 18 Motion to Withdraw, the 21 REPORT AND RECOMMENDATION and the 23 Motion to reinstate are all denied as moot; FURTHER ORDERED that the second 26 Motion to Withdraw is granted, the 1 Petition for Writ of Habeas Corpus in this case is deemed to be withdrawn because it is moot; and the Clerk of the Court shall enter judgment of dismissal, without prejudice, accordingly. On July 28, 2009, Petitioner moved to withdraw his habeas petition because he had been told he was being released from custody. On August 8, 2009, the Magistrate Judge issued a Report and Recommendation recommending that this Court grant the motion to withdraw. On August 11, 2009, Petitioner moved to reinstate his petition because he had not been released. On August 25, 2009, the Government filed a notice that this case was moot because Petitioner had been released. On August 26, 2009, Petitioner again moved to withdraw his Petition.
