ORDER that the Clerk of Court must terminate Doc. 26 in CR 10-1020-PHX-MHM. The Amended Motion under 28 U.S.C. § 2255 to Vacate, Set Aside or Correct Sentence (Doc. 4 in CV 10-2591-PHX-MHM (DKD)) is denied and the civil action opened in connec tion with this Motion (CV 10-2591-PHX-MHM (DKD)) is dismissed with prejudice. The Clerk of Court must enter judgment accordingly; in the event Movant files an appeal, the Court declines to issue a certificate of appealability because reasonable jurists would not find the Courts procedural ruling debatable.
