ORDER that Counts One, Three, Four, Five, and Six are dismissed without prejudice. Defendants Betty Barnes, Unknown Carrillo, G Coranado, K Curran, Unknown French, Rita Frigo, T Hernandez, Unknown Johnson, Dennis Kendall, Unknown Kurtz, D Lunberg, Un known MacKenzie, Brenda McMullen, Jon Meade, Unknown Merrifield, Unknown Montoya, Unknown Penney, Anne Reeder, Pattie Rowe, Charles L Ryan, R Schmidt, Unknown Talley, Unknown Villa, Arizona Department of Corrections and Unknown Baird are dismissed wi thout prejudice. Defendant Preston must answer Count Two. The Clerk must send Plaintiff a service packet including 10 First Amended Complaint, this Order, and both summons and request for waiver forms for Defendant Preston. Plaintiff must complete and return the service packet to the Clerk of Court within 21 days of the date of filing of this Order. This matter is referred to Magistrate Judge Edward C.
