MOTION FOR A
CONTINUANCE

Defendants Arizona Medical Marijuana Association, Arizona Association of
Dispensary Professionals, Serenity Arizona, Holistic Health Management, Joshua Levine,
Paula Pennypacker, Nicholas Flores, Jane Christensen, Paula Pollock, and Jeff Silva
hereby respectfully request an adjournment of the motion hearing in this matter, currently
scheduled for Monday, October 24, 2011. Counsel for all parties consent.
Defendants’ request is based on the following:
Last night the mother of Defendants’ lead counsel, Ezekiel R. Edwards, was
admitted to the emergency room. At present, her condition is quite serious. She lives
alone and Defendants’ lead counsel is her primary caretaker. Under these circumstances,
Defendants’ lead counsel is requesting an adjournment of 30 days on the motion hearing
in this case currently scheduled for this Monday, October 24, 2011. No other counsel for
Defendants is available to argue this matter.
Prior to filing this motion, Defendants’ lead counsel conferred with both Plaintiff
Arizona’s counsel, Assistant Attorney General Lori Davis, and counsel for federal
Defendants, Assistant United States Attorney Scott Risner, both of whom have consented
to Defendants’ request for an adjournment.
Mr. Risner indicated that he is unavailable between October 29, 2011, and
December 5, 2011, and thus would ask that the Court not schedule the hearing prior to
December 6, 2011.
