On June 14, 2012, the Court ordered Plaintiff to file a supplement to the first amended
20
complaint to allow this Court to independently review its jurisdiction. Plaintiff filed a second
21
amended complaint. An amended complaint completely supersedes the prior complaint.

Forsyth v. Humana, Inc., 114 F.3d 1467, 1474 (9th Cir. 1997). Accordingly, a party cannot
23
use an “et al.” designation on an amended complaint. Additionally, the Court allowed a
24
supplement to the amended complaint under Federal Rule of Civil Procedure 15(d), not a
25
completely amended complaint under 15(a). For both of these reasons, the second amended
26
complaint, filed without leave of Court, is improper.

Therefore,

IT IS ORDERED striking the second amended complaint (Doc. 47).
