Jeffrey Crandell is confined in the Federal Correctional Institution-La 18 Tuna in Anthony, Texas. The Court will dismiss the motion with leave to file an amended 19 motion. 20 I. Procedural History 21 Pursuant to a plea agreement, Jeffrey Crandell pleaded guilty to six counts of bank 22 fraud, in violation of 18 U.S.C. § 1344. The plea agreement did not include any agreements 23 regarding sentencing, but the government agreed to a two point reduction in the applicable 24 sentence guideline level for acceptance of responsibility. On March 31, 2010, the Court 25 sentenced Mr. Crandell to a 62-month term of imprisonment, a period below the low end of 26 the suggested federal sentencing guideline range, followed by five years on supervised 27 release. 28 Tanya Crandell seeks relief on behalf of her husband. She alleges four grounds. In 1 each, she seeks modification of the terms of her husband’s sentence so that he may serve his 2 sentence in home confinement. 3 II. Standard for § 2255 Relief 4 Movant asks that her husband be held in a facility closer to his family’s home and/or 5 for home confinement. The Constitution solely confers on the President the “power to grant 6 reprieves and pardons for offenses against the United States.” U.S. Const. art. II, § 2, cl.1; 7 see United States v. Pollard, 416 F.3d 48, 50, 57 (D.C. Cir. 2005); Binion v. U.S. Dept of 8 Justice, 695 F.2d 1189, 1190 (9th Cir. 1983); United States v. Missio, 597 F.2d 60, 62 (11th 9 Cir. 1979). Thus, an application for federal clemency must be made to the President for such 10 relief and may not obtain clemency in § 2255 proceedings. 11 A motion filed pursuant to 28 U.S.C. § 2255 is a post-conviction remedy for a federal 12 prisoner claiming the right to be released upon the grounds that: (1) the judgment or sentence 13 was imposed in violation of the Constitution or laws of the United States; (2) the court lacked 14 jurisdiction to impose such sentence; (3) the sentence was in excess of the maximum 15 authorized by law; or (4) the judgment or sentence is otherwise subject to collateral attack. 16 See Rule 1(a), Rules Governing § 2255 Proceedings. Further, a § 2255 motion must be 17 signed by the federal prisoner under penalty of perjury or by an attorney representing him. 18 See 28 U.S.C. § 2242; Rule 2(b) of the Rules Governing Section 2255 Proceedings for the 19 United States District Courts; see also United States v. Bautista-De La Cruz, No. CV11- 20 0483-PHX-JAT, 2011 WL 939289, at *1 (D. Az. Mar. 17, 2011). 21 The instant motion fails to allege a violation of the Constitution or laws of the United 22 States. Further, it has not been signed by Mr. Crandell or by an attorney representing him. 23 For both reasons, the motion will be denied with leave to file an amended motion. 24 III. Leave to Amend 25 Mr. Crandell will be granted leave to file an amended motion pursuant to 28 U.S.C. 26 § 2255. He must submit such motion on the court-approved form and must sign it under 27 penalty of perjury. If Mr. Crandell fails to file an amended motion within 30 days from the 28 date of filing of this Order, the Court will dismiss this § 2255 action, without further notice -2- 1 to him, for failure to comply with Local Rule of Civil Procedure 3.5(a). If Mr. Crandell fails 2 to use the court-approved form, the Court may strike the amended motion and dismiss this 3 § 2255 action without further notice to him. 4 Mr. Crandell must clearly designate on the face of the document that it is an 5 “Amended Motion.” The amended motion must be retyped or rewritten in its entirety on a 6 court-approved form and may not incorporate any part of the original Motion by reference. 7 Mr. Crandell must describe each ground for relief and the facts supporting each 8 ground. 9 An amended motion supersedes the original Motion. See Ferdik v. Bonzelet, 963 F.2d 10 1258, 1262 (9th Cir. 1992); Hal Roach Studios v. Richard Feiner & Co., 896 F.2d 1542, 1546 11 (9th Cir. 1990). After amendment, the Court will treat the original Motion as nonexistent. 12 Ferdik, 963 F.2d at 1262. Any ground for relief that was raised in the original Motion is 13 waived if it is not raised in an amended motion. See King v. Atiyeh, 814 F.2d 565, 567 (9th 14 Cir. 1987). 15 If Mr. Crandell files an amended motion, he should include every ground for relief 16 that he wishes to raise. If the Court adjudicates the merits of an amended motion, any 17 subsequent motion for § 2255 relief will be treated as “[a] second or successive motion,” 18 which requires certification by a panel of the appropriate court of appeals pursuant to 28 19 U.S.C. § 2244 before it is filed. 28 U.S.C. § 2255(h); Rule 9, Rules Governing § 2255 20 Proceedings. 21 IV. Warnings 22 A. Address Changes 23 Mr. Crandell must file and serve a notice of a change of address in accordance with 24 Rule 83.3(d) of the Local Rules of Civil Procedure. He must not include a motion for other 25 relief with a notice of change of address. Failure to comply may result in dismissal of this 26 § 2255 action. 27 B. Copies 28 Mr. Crandell must submit an additional copy of every filing for use by the Court. See -3- 1 LRCiv 5.4. Failure to comply with this requirement may result in the filing being stricken 2 without further notice to him. 3 C. Possible Dismissal 4 If Mr. Crandell fails to timely comply with every provision of this Order, including 5 these warnings, the Court may dismiss this § 2255 action without further notice. See Ferdik, 6 963 F.2d at 1260-61 (a district court may dismiss an action for failure to comply with any 7 order of the Court). 8 IT IS ORDERED: 9 (1) 10 All further filings in the civil action must include the criminal case number in the caption as it appears in this Order.
