Petitioner filed his Petition for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2254

on July 26, 2012 raising four grounds for relief: 1) ineffective assistance of trial counsel in
18
violation of the Sixth Amendment; 2) denial of due process in violation of the Fourteenth
19
Amendment; 3) a multiplicitous indictment and prosecutorial misconduct in violation of the
20
Fifth Amendment; and 4) cumulative errors at trial in violation of his right to present a
21
complete defense. On November 29, 2012, Respondents filed their Response to Petitioner’s
22
Petition for Writ of Habeas Corpus. Petitioner filed a reply on December 20, 2012. On April
23
29, 2013, the Magistrate Judge issued his Report and Recommendation recommending that
24
the petition be denied and dismissed with prejudice because the Petition was barred by the
25
statute of limitations.

In his Report and Recommendation the Magistrate Judge advised the parties that they
27
had 14 days from the date of service of a copy of the Report and Recommendation within
28

which to file specific written objections with the Court. The time to file such objections has
2
expired and no objections to the Report and Recommendation have been filed.

The Court finds itself in agreement with the Report and Recommendation of the
Magistrate Judge.
IT IS ORDERED adopting the Report and Recommendation of the Magistrate Judge
as the order of this Court.
IT IS FURTHER ORDERED that the Petition for Writ of Habeas Corpus is denied
and dismissed with prejudice because it is barred by the statute of limitations.
