The Plaintiffs filed suit against Bob Perciasepe, then Acting Administrator of the
United States Environmental Protection Agency, in his official capacity. Pursuant to Federal
Rule of Civil Procedure 25(d), the Court substitutes Gina McCarthy, who succeeded
Perciasepe as the Administrator.
