Gurule, ORDER 13 Respondent. 14 15 Petitioner Muhammed Nazmul Hasan (A200-610-307), who is confined in the 16 Florence Service Processing Center in Florence, Arizona, has filed a pro se Petition under 17 28 U.S.C. § 2241 for a Writ of Habeas Corpus by a person in federal custody. The Court 18 will dismiss the Petition with leave to file an amended petition. 19 I. Petition 20 21 United States without being admitted or paroled and was taken into the custody of 22 Immigration and Customs Enforcement (ICE). On June 21, 2011, an Immigration Judge 23 (IJ) denied his applications for asylum and for deferral of removal and ordered that he be 24 removed to Bangladesh. On November 30, 2011, the Board of Immigration Appeals 25 (BIA) dismissed his appeal. On December 9, 2011, he filed a petition for review with the 26 United States Court of Appeals for the Ninth Circuit. On May 9, 2012, the Ninth Circuit 27 granted a stay of removal pending review. The Ninth Circuit recently granted his petition 28 JDDL Petitioner is a native and citizen of Bangladesh. On June 24, 2010, he entered the and remanded his case to the BIA for further administrative proceedings. M.N.H. v. 1 Holder, No. 11-73765, 2013 WL 2284920 (9th Cir. May 24, 2013) (unpublished 2 memorandum). Petitioner argues that he is entitled to release under Zadvydas v. Davis, 3 533 U.S. 678 (2001), because he has been detained for more than six months and his 4 removal to Bangladesh is not reasonably foreseeable. He seeks an order compelling 5 Respondent to grant him supervised release. 6 Petitioner is not eligible for relief under the rule announced in Zadvydas because it 7 does not apply to aliens, like Petitioner, against whom removal proceedings are still 8 pending. Following the entry of a final order of removal, an alien is subject to mandatory 9 detention during the 90-day removal period. 8 U.S.C. § 1231(a)(2). If he cannot be 10 removed within the 90-day removal period, the alien may be granted supervised release 11 or he may be further detained. 8 U.S.C. § 1231(a)(3). Under 8 U.S.C. § 1231(a)(6), an 12 alien who is inadmissible under 8 U.S.C. § 1182 or removable under 8 U.S.C. 13 §§ 1227(a)(1)(c), (a)(2), or (a)(4), “may be detained beyond the removal period.” 8 14 U.S.C. § 1231(a)(6). 15 government will accept the alien’s return in the reasonably foreseeable future, the 16 government may not detain the alien for more than the presumptively reasonable period 17 of six months. Zadvydas, 533 U.S. at 701. That rule has no application to Petitioner’s 18 case because administrative removal proceedings are still pending against him and he is 19 not detained under 8 U.S.C. § 1231. Because Petitioner has failed to identify any 20 cognizable claim for habeas corpus relief, his Petition will be dismissed with leave to file 21 an amended petition identifying a proper statutory or constitutional basis for his claim 22 that his current detention is unlawful. 23 II. Who May Use This Form. If you are detained in Arizona, you may use this form to challenge your detention by federal immigration authorities or to challenge the execution of your federal sentence by the United States Bureau of Prisons. All questions must be answered clearly and concisely in the appropriate space on the form. If needed, you may attach additional pages. The form, however, must be completely filled in to the extent applicable. You do not need to cite law. If you want to file a brief or arguments, you must attach a separate memorandum. 3. Your Signature. You must tell the truth and sign the form. If you make a false statement of a material fact, you may be prosecuted for perjury. 4. The Filing Fee. The filing fee for this action is $5.00. If you are unable to pay the filing fee, you may request permission to proceed in forma pauperis by completing and signing the Application to Proceed In Forma Pauperis provided with the petition form. You must have an official at the prison or jail complete the certificate at the bottom of the application form.
