CD No. 32. Rule 24(b)(2)(B) of the Federal Rules of Civil Procedure provides for intervention in the exact circumstance present in the instant action. Plaintiff believes that granting the four Arizona cities request will provide for a 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 more complete presentation of the facts and enhance an understanding of the relevant law. The "Support Our Law Enforcement and Safe Neighborhoods Act," Senate Bill 1070, as amended by House Bill 2162, which becomes effective July 29, 2010, involves numerous material facts and the applicable law is complex. Additionally, the equitable relief sought by all plaintiffs is critical to protecting the interests of local law enforcement officers, all Arizona cities, all Latinos citizens, residents, and guests of Arizona, and all persons present within the State of Arizona on July 29th and thereafter. Intervention is reasonable, appropriate and will not prejudice the interests of any party. For the reasons noted, Plaintiff respectfully urges granting the cities of Flagstaff, Tolleson, San Luis and Somerton's motion for intervention.
