Brewer, et. al., CV 10-00249 DCB, notifies the Court that it concurs with Plaintiff Martin Escobar's Request for Transfer and Consolidation filed in that case as set forth in Tucson's Joinder in Motion to Consolidate (Dkt #23). Both cases address the same issues and have very similar pleadings. Both cases also include municipalities as defendants and {A0028922.DOC/} 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 thus raise the specific issues regarding the impact of SB 1070 on municipalities. Four additional Arizona cities have filed a motion to intervene in the Escobar case (Dkt. Nos. 32 and 33). The Plaintiffs in both cases are represented by the same attorneys and similar motions for preliminary injunctive relief have been filed by the plaintiffs in both cases. The City has also filed its motion for preliminary injunctive relief which both complements and supplements the briefs filed by the two Plaintiffs. The City submits that such consolidation is appropriate independent of the decision in Frisancho v. Brewer, et al., 10-cv-00926-SRB on the pending motion to transfer both cases to that court. With respect to the pending request in the Frisancho case to transfer all pending cases to the Frisancho case, the City agrees that all five cases have common theories and should be heard by a single judge to avoid inconsistent judgments.
