ORDER that the magistrate-judge referral (Doc. 9 at 4) is withdrawn. It is further Ordered that Petitioner's Petition for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2254 (Doc. 1 ) is denied, and this action is dismissed with prejud ice. The Clerk of Court is directed to enter judgment accordingly and close this case. It is further Ordered that, pursuant to Rule 11 of the Rules Governing Section 2254 Cases, the Court declines to issue a certificate of appealability, because reasonable jurists would not find the Court's ruling debatable.
