ORDER adopting 4 Recommendation and overruling Scheurich's 5 objections. Nothing in Scheurich's objections shows he's in imminent danger of serious physical injury. The 1 Motion to proceed IFP is denied. Scheurich's complai nt will be dismissed without prejudice. If he wants to proceed with this case, then he must pay the $400 filing and docketing fees or file a motion to reopen by 9/7/2017.
