ORDER DISMISSING CASE without prejudice pursuant to 15 Defendant's Notice of Bankruptcy. The Clerk is directed to administratively terminate this case without prejudice to the rights of the parties to re-open for good cause shown, for the ent ry of any stipulation or order, or for any other purpose required to obtain a final determination of the litigation. This case will, however, be re-opened only if an application to re-open is filed w/i 60 days of the final disposition of the Bankruptcy proceeding. ORDER The court has received notice that defendant has filed a petition in the United States Bankruptcy Court for the Southern District of New York. IT IS THEREFORE ORDERED that all pending motions are denied without prejudice and that the Clerk administratively terminate this case without prejudice to the rights of the parties to reopen this case for good cause shown, for the entry of any stipulation or order, or for any other purpose required to obtain a final determination of the litigation. This case will, however, be re-opened only if an application to re-open is filed within sixty (60) days of the final disposition of the Bankruptcy proceeding.
