ORDER ADOPTING 30 REPORT AND RECOMMENDATIONS in their entirety as this Court's findings in all respects. It is therefore ordered that Defendant's first 26 and second 28 motions to dismiss are granted. This cause of action is dismissed without prejudice. IT IS, THEREFORE, ORDERED that: 1. Defendant’s first and Second Motions to Dismiss (Doc. Nos. 26, 28) are GRANTED. 2. This cause of action is DISMISSED without prejudice. 3. The Court certifies, pursuant to 28 U.S.C. § 1915(a)(3), that an in forma pauperis appeal from this Order and the accompanying Judgment would not be taken in good faith.
