ORDER denying 10 Motion for summary judgment. The Court requests that Moore consider whether to dismiss the state law claim without prejudice and to advise in the pretrial disclosure sheet. This case is first out for bench trial in Jonesboro, 9:00 a.m. on Tuesday, 7 June 2016. The Amended Final Scheduling Order, 8 , is further amended. No trial briefs or responding trial briefs are needed. The parties' summary judgment briefs will do just fine. No proposed findings and conclusions are ne eded; instead, the Court encourages the parties to collaborate on and file a stipulation about undisputed backgrounds facts. Any stipulation is due 6 May 2016. Copy of exhibits due to chambers by 1 June 2016. Original exhibits to be delivered to the courtroom deputy on June 7. Lastly, the Court sees no need for a pretrial.
