Accordingly, Plaintiff's Motion for Partial Summary Judgment (Doc. No. 34) is DENIED without prejudice to refiling after proper discovery has been completed, and Defendant's Motion for Extension of Time (Doc. No. 37) is DENIED as MOOT.
