States the Western District of Tennessee for coordinated o r consolidated pretrial proceedings p u r s u a n t r o 28 U.S.C. § 1407. See 598F.Supp.2d 1379 (J.P.M.L. 2009). Sincethattime, five additional actions have b e e n transferred to the Western District ofTennessee. With the consent ofthat court, all such actions have been assigned to the Honorable Samuel H. Mays, Jr. It appears that the actions on this conditional transfer order involve questions of fact that are common to the actions previously transferred to the Western District of Tennessee a n d assigned to Judge Mays. Pursuant to Rule 7.4 ofthe Rules ofProcedure o f the Judicial Panel o n Multidistrict Litigation, 199 F.R.D. 425,435-36 (2001), these actions are transferred under 28 U.S.C. § 1407 to the Western District o f Tennessee for the reasons stated in the order ofFebruary 12, 2009, and, w i t h the consent of that court, assigned to the Honorable Samuel H. Mays, Jr. This order does not become effective until it is filed in the Office of the Clerk of the United States District Court for the Western District ofTennessee. The transmittal ofthis order t o said Clerk shall be stayed 15 days from the entry thereof. Ifany party files a notice ofopposition with the Clerk of the Panel within this IS-day period, the stay will be continued until further order of the Panel.
