REPORT AND RECOMMENDATIONS that Defendants' 25 MOTION for Summary Judgment be GRANTED; that Plaintiff's Complaint against Defendant Zulpo be DISMISSED without prejudice; that Plaintiff's Complaint against Defendants Howell, Gibson an d Hobbs be DISMISSED without prejudice; and that dismissal constitute a "strike" within the meaning of the Prison Litigation Reform Act (PLRA), 28 U.S.C. § 1915(G); objections much be received no later than 10 days from the date of the findings and recommendations.
