REPORT AND RECOMMENDATIONS that Plaintiff's Complaint be DISMISSED with prejudice for failure to state a claim upon which relief may be granted; that dismissal of this action constitute a "strike" for purposes of 28 U.S.C. § 1915( g); that the Court certify, pursuant to 28 U.S.C. § 1915(a)(3), that an in forma pauperis appeal from the Order adopting these recommendations and the accompanying Judgment would not be taken in good faith; objections must be received no later than 14 dates from the date of the findings and recommendations.
