Curtis v. Hobbs et al

Filing 32

ORDER adopting 30 Recommendation and overruling Curtis's objection, 31 with one modification. Curtis's individual capacity claims will be dismissed without prejudice because Heck might not bar Curtis's claim if his parole revocation were expunged by executive order. The defendants' second motion to dismiss, 22 , is granted. Curtis's complaint will be dismissed for failure to state a claim. Signed by Judge D. P. Marshall Jr. on 3/22/2016. (jak)
