ORDER dismissing Hodges' complaint without prejudice. The dismissal is without prejudice to the Defendants' renewing their motion for summary judgment if Hodges refiles the same action against them. The 25 Recommendation is declined with out prejudice as moot, and the 21 motion for summary judgment is denied without prejudice as moot.
