The Court has reviewed the Proposed Findings and Recommendations submitted by
United States Magistrate Judge H. David Young and the objections filed by Howard Vance

IT IS THEREFORE ORDERED THAT:
Defendants’ motion for summary judgment (Dkt. No. 47) is granted, and Mr.
Garner’s complaint is dismissed without prejudice.
The Court certifies that an in forma pauperis appeal taken from the order and
judgment dismissing this action is considered frivolous and not in good faith.
SO ORDERED this 30th day of May, 2013.
