DEFENDANTS ORDER The proposed findings and recommended disposition submitted by United States Magistrate Judge Jerome T. Kearney and the filed objections have been reviewed. After carefully considering these documents and making a de novo review of the record, it is concluded that the proposed findings and recommended disposition should be, and hereby are, approved and adopted in their entirety in all respects. IT IS THEREFORE ORDERED that: 1. Plaintiff Frederick Pennington’s motion to proceed in forma pauperis [Doc. No. 1] be denied. 2. Should Pennington wish to continue this case, he is required to submit the statutory filing fee of $350 to the Clerk, noting the above case style and number within ten (10) days of the date of this order, together with a motion to reopen this case.
