is GRANTED.

Plaintiff’s claims against Defendant Lay are DISMISSED without prejudice.

3)

Plaintiff’s claims against Defendant May are DISMISSED with prejudice.

4)

Plaintiff’s Motion for Summary Judgment (Doc. No. 34) is DENIED without

prejudice.
