IT IS THEREFORE ORDERED THAT:

Defendants’ motions for summary judgment [Doc. Nos. 26 & 29] are granted,

and plaintiff’s complaint is dismissed with prejudice.
2.

Plaintiff’s motion for summary judgment [Doc. No. 33] is denied.

3.

The court certifies that an in forma pauperis appeal taken from the order and

judgment dismissing this action is considered frivolous and not in good faith.
