ORDER adopting 97 Proposed Findings and Recommended Disposition in their entirety as this Court's findings in all respects. Defendants' 84 87 motions for summary judgment are GRANTED, and Plaintiff's 2 complaint is DISMISSED WITH PREJUDICE. Plaintiff's 82 motion for a preliminary injunction, and his 93 94 counter motions for summary judgment, are DENIED. The Court certifies that an in forma pauperis appeal taken from the order and judgment dismissing this action is considered frivolous and not in good faith. Signed by Judge J. After carefully considering the objections and making a de novo review of the record in this case, the Court concludes that the Proposed Findings and Recommended Disposition should be, and hereby are, approved and adopted in their entirety as this Court's findings in all respects. IT IS THEREFORE ORDERED THAT: 1. Defendants’ motions for summary judgment (docket entries #84 & #87) are GRANTED, and Plaintiff’s complaint is DISMISSED WITH PREJUDICE. 2. Plaintiff’s motion for a preliminary injunction (docket entry #82), and his counter motions for summary judgment (docket entries #93 & #94), are DENIED. 3.
