ORDER adopting 121 Recommendation. Defendants' motion for summary judgment, 111 , is granted. Martz's claims against Jones Foster, Iko, and York will be dismissed without prejudice for failure to exhaust. His claims against Boettger will be dismissed without prejudice for failure to serve.
