JUDGMENT Before the Court is the Report and Recommendation filed October 7, 2010 by the Honorable Barry A. Bryant, United States Magistrate Judge for the Western District of Arkansas. (Doc. 25). Judge Bryant recommends that Plaintiff's Motion for Summary Judgment (Doc. 16) be DENIED and Defendant's Motion to Dismiss (Doc. 6) be GRANTED. The parties have not filed objections to this Report and Recommendation, and the time to object has passed. See 28 U.S.C. § 636(b)(1).
