IT IS FURTHER ORDERED that, for the reasons stated in the
Report and Recommendation, Michael Fitzhugh's Petition Under 28
U.S.C. § 2254 for Writ of Habeas Corpus (document #1) is hereby
denied, and this case is dismissed without prejudice.
