law
in

and
sufficiently
respects,
fact
to
and
refute
that
the
Recommendation.
IT IS THEREFORE ORDERED that the Report and Recommendation of
the Magistrate Judge (document #10) is hereby adopted in toto, and
plaintiff's objection is overruled;
IT IS FURTHER ORDERED that, for the reasons stated in the
Report and Recommendation, plaintiff's Application to Proceed In
Forma Pauperis (document #2) is denied, and this case is dismissed
with prejudice. The Clerk is directed to place a ยง 1915(g) strike
flag on this case.
