The Court has reviewed the Report and Recommendation advised, finds plaintiff has that stated it is and, being sound neither law in well all nor and sufficiently respects, fact to and refute that the Recommendation. IT IS THEREFORE ORDERED that the Report and Recommendation of the Magistrate Judge (document #10) is hereby adopted in toto, and plaintiff's objection is overruled; IT IS FURTHER ORDERED that, for the reasons stated in the Report and Recommendation, plaintiff's Application to Proceed In Forma Pauperis (document #2) is denied, and this case is dismissed with prejudice.
