and recommendation is proper, contains no clear error, and is ADOPTED IN ITS ENTIRETY.
IT IS THEREFORE ORDERED that Defendant’s motion for summary judgment (Doc. 28)
is GRANTED and this case is DISMISSED WITH PREJUDICE.
