Accordingly, Defendant’s Motion to Dismiss (doc. 13) is

GRANTED as Plaintiff’s claims are barred by sovereign immunity and
lack of subject matter jurisdiction.

Accordingly, Plaintiff’s

Complaint is DISMISSED WITH PREJUDICE.
