Courtroom: 14 18 19 ORDER APPROVING PAYMENT OF INTERIM ATTORNEYS’ FEES AND COSTS 20 The parties have filed a Stipulation regarding payment of attorneys’ fees and 21 22 costs incurred by Plaintiffs’ counsel in regard to the above-captioned litigation 23 incurred during the period January 1, 2010, through December 31, 2010 24 (Stipulation). The California Department of Health Care Services (CDHCS) has 25 agreed to pay the total amount of $198,531 in attorneys’ fees, costs and expenses in 26 full and complete satisfaction of any claims to such fees and costs by Plaintiffs or 27 Plaintiffs’ counsel for the period January 1, 2010, through December 31, 2010. 28 /// 1 1 2 GOOD CAUSE HAVING BEEN SHOWN: 1. CDHCS is ordered to pay Plaintiffs’ counsel the sum of $198,531 in 3 attorneys’ fees, costs and expenses for fees and costs incurred during the period 4 January 1, 2010, through December 31, 2010. 5 2. Said fees and costs shall be paid to the Western Center on Law and 6 Poverty (Western Center), Federal I.D. No. 95-2897721. Payment shall be mailed 7 to the Western Center, to the attention of Plaintiffs’ attorney, Richard A. 8 Rothschild. 9 3. If the principal sum set forth in paragraph 1 above is not paid within 10 90 days after this order is served on Defendant’s counsel by the Court (through the 11 Central District’s e-filing notification system), then this sum shall be payable with 12 interest calculated from the first day after the expiration of the 90-day period up to 13 and including the date of actual payment, at the rate prescribed by 28 U.S.C. 14 section 1961. 15 4. Upon payment of the sum set forth in paragraph 1 above, plus interest 16 (if applicable), the State of California, the Director of CDHCS, and CDHCS, its 17 officers, agents, and employees, are released and forever discharged from any and 18 all liability for attorneys’ fees and costs arising out of this litigation incurred from 19 January 1, 2010, through December 31, 2010. 20 5. The parties shall execute any further documents consistent with the 21 Stipulation and this Order that may be necessary to effectuate the purposes of the 22 Stipulation and Order. 23 24 DATE: September 13, 2011____ _________________________ A.
