Plaintiff ValueClick, Inc. ("ValueClick") and Defendant Revenue Science, Inc. ("RSI"), through their respective attorneys of record, hereby provide the Court with

4 notice that a tentative settlement has been reached between the parties. The form of 5 the settlement has been agreed to, subject only to final board approval by one party. 6 7

While the parties anticipate filing a formal notice of dismissal within a few

8 days, because of the hearing scheduled for February 11, 2008, the parties wished to 9 advise the Court as soon as an accord was reached in order to avoid any unnecessary 10 11
