25 to these Motions, NOW FINDS AND RULES AS FOLLOWS:

The Court hereby DENIES Plaintiff’s Motions.
This
27 Action is currently on appeal before the Ninth Circuit,
28 Case No. 11-56248.
Thus, the Court finds that it does

1 not have jurisdiction over such matters.
Griggs v.
2 Provident Consumer Disc. Co., 459 U.S. 56, 58 (1982)
3 (“The filing of a notice of appeal is an event of
4 jurisdictional significance-it confers jurisdiction on
5 the court of appeals and divests the district court of
6 its control over those aspects of the case involved in
7 the appeal.”).
Accordingly, the Court hereby DENIES
8 Plaintiff’s Motions.
