That Plaintiff take nothing against defednant Michael Gennaco and taht the action be dismissed on the merits as to Defendant Michael Gennaco shall have judgment entered forthwith as requested in said motion in favor of himself and against plaintiff Alejandro Franco. Defendant Michael Gennaco shall be entitled to costs pursuant to FRCP, Rule 54. (jp)
