MEMORANDUM AND ORDER DISMISSING FIRST AMENDED COMPLAINT WITH LEAVE TO AMEND by Judge Manuel L. Real. The RICO claims in the First Amended Complaint are dismissed without leave to amend. The malicious prosecution claim in the First Amended Complaint is dismissed without leave to amend as against Defendants Favis, Ferris, Staal, Lawrence, Bridgewater and McKerren. The First Amended Complaint otherwise is dismissed with leave to amend. If Plaintiff still wishes to pursue this action, he is grant ed 30 days from the date of this Memorandum and Order within which to file a Second Amended Complaint. The Second Amended Complaint shall be complete in itself. It shall not refer in any manner to any prior complaint. Failure to file timely a Second Amended Complaint may result in the dismissal of this action. (sp)
